Terms and conditions of Use

The website: https://site.join2work.com/cr and the J2W Platform: https://join2work.com/login are managed and operated by OUTSOURCE EMPRESARIAL, LIMITED, (hereinafter referred to as ‘J2W’), with its address at Europlaza, Tower 1 8º floor, office 804, 5ª avenue 5-55, zone 14, Guatemala City, Guatemala, also for receiving notices.

1. Use of the Website.

 The Terms and Conditions of Use presented below constitute the agreement between J2W, whose website address is https://site.join2work.com/cr and its Mobile Application (hereinafter referred to as the ‘Website’), the J2W Platform: https://join2work.com/login (hereinafter referred to as the ‘J2W Platform’), and any User of these.

The use of the Website by any individual confers the status of user, regardless of whether their assigned role is as ‘Administrator’ or ‘User’ (hereinafter referred to as the ‘User’), and implies their tacit, full, and unconditional acceptance of these Terms and Conditions of Use in effect at the time of use. Consequently, it is essential for the User to read and carefully review them beforehand, ensuring they are aware that they are subject to these terms and to any modifications that may be published periodically on the Website.

It is suggested that the User carefully read the Terms and Conditions of Use each time they access the Website, as these may be updated or modified by J2W at any time, without direct personal notification to the User, since they can be reviewed on the website: https://site.join2work.com/ or on the J2W Platform: https://join2work.com/login.

The conditions of access and use of this Site are governed by the current legislation in accordance with the territorial jurisdiction of the service provider as indicated in the first paragraph of this document and by the principle of good faith, with the User committing to making proper use of it. Behaviors that violate the law, the rights, or the interests of third parties are not allowed.

If at any time the User disagrees, wholly or partially, with these Terms and Conditions of Use, they must immediately refrain from using the Site in any of its parts or sections

1.1 Access and Use of the Site. 

Access to the Site is conducted via the internet by entering https://site.join2work.com/cr into the browser, or by downloading the App through the app store (iOS, Android) corresponding to the mobile device intended for access. Access to the J2W Platform is made through the Site or via its direct link https://join2work.com/login,  which, in this case, requires the acquisition of the corresponding license for its use (see Section 2 of this document). The User will be required to register or sign up on the Site only in cases where they are specifically requested to do so.

 1.2  Purpose. 

J2W is a technological suite designed to facilitate the management of Human Resources tasks. On the J2W Platform, you can perform self-management of human resource files, task and vacation management, payroll calculation, and time tracking, among other functions, which are described in greater detail in Section 2 of these Terms and Conditions of Use.

 

Through the Site, J2W provides Users with access to information about the J2W Platform, including its description, composition, subscription plans, and testimonials.

1.3 Contents. 

The User acknowledges that the use of the Site does not grant them any intellectual property rights or any other type of rights over it, any of its elements, or “Contents” (defined in a non-limiting manner as all those elements that make up the J2W Platform, functionalities, images, code, development, trademarks, trade names, slogans, signs, logos, and photographs).

 

The trademarks, trade names, slogans, signs, logos, and photographs used, published, inserted, or included on this site are the exclusive property of J2W and are protected by the applicable industrial and/or intellectual property laws.

 

J2W reserves the right to modify at any time and without prior notice the presentation, configuration, information, Contents, and, in general, any part or aspect directly or indirectly related to the Site.

 

1.3.1 Obligation to Make Proper Use of the Site and the Contents.

 

The User agrees to use the Site and its Contents in accordance with applicable laws, the provisions of these Terms and Conditions of Use, and with respect for public order.

 

For the proper use of the Site, the User is primarily obliged to:

 

  1. A) Use the Site and any Content or aspect related to it responsibly, in a manner that does not harm the rights or interests of J2W, of individuals directly or indirectly associated with it, or of third parties.
  1. B) Use the Site and/or the Contents in such a way that does not damage, disable, deteriorate, or partially or entirely impair them.

1.3.2 Means for Obtaining Contents.

The User must refrain from obtaining or attempting to obtain information, messages, graphics, drawings, sound and/or image files, photographs, recordings, software, and, in general, any kind of material accessible through the Site or its Contents.

The use of the Contents and elements found on the Site is allowed only by employing the tools, functionalities, or procedures established and indicated within the Site, or, where applicable, by obtaining prior authorization from J2W.

1.3.3 Proper Use of the Contents.

The User is obligated to use the Contents and elements available on the Site in a diligent, proper, and lawful manner, and undertakes to refrain from:

(a) Using the Contents unlawfully, for purposes or effects contrary to the law, public order, or the provisions established by J2W for the use of this Site;

(b) Copying, distributing, modifying, reproducing, disseminating, or using the Contents and elements available on the Site in any way, whether for profit or not.

(c) Altering or manipulating the trademarks, logos, trade notices, trade names, and distinctive signs, in general, that are the property of J2W, the Site, or persons directly or indirectly linked to the company.

(d) Removing, bypassing, or altering the Contents and elements available on the Site, as well as the technical protection devices or any mechanism or procedure established on the Site.

J2W declares that all the Contents and elements available on the Site are duly registered and protected under the relevant authorities and applicable laws. The User is obliged to respect all Intellectual Property rights over the Contents and elements available on the Site owned by J2W.

1.3.4 Use of the Site and its Contents under the Exclusive Responsibility of the User.

By merely accessing the Site, the User acknowledges and agrees that the use of the Site and its Contents is under their exclusive and strict responsibility, therefore, J2W shall not, at any time or under any circumstances, be held responsible for any malfunction or problem that occurs in the User’s computer equipment (hardware) or computer programs (software) used to access or navigate any part of the Site.

1.3.5 Responsibility for the Management and Administration of Contents within the J2W Platform.

 

The User expressly acknowledges and agrees that:

 

  1. In cases where they publish content attributable to an author other than J2W, they will bear exclusive responsibility as the author, disseminator, or reproducer of such information. Therefore, J2W is not responsible for the truthfulness, legitimacy, accuracy, or reliability of any content the User enters into the J2W Platform while using its various functionalities.
  1. J2W will also not be responsible for errors, omissions, or potential damages caused by the User entering incorrect, incomplete, unverified, or unauthorized information into the J2W Platform for use of its functionalities.
  1. J2W is not liable for any improper use or mismanagement by the User of their access credentials (login and password).

 

1.4 Proper Use of the J2W Platform.

The User is prohibited from publishing illegal, threatening, slanderous, defamatory, obscene, scandalous, or pornographic material, or any other material that could result in civil or criminal liability under applicable law.

 

All comments published must be written in a cordial and respectful language and must be related to the service or product being commented on. Likewise, the User agrees not to impersonate another person or entity, introduce false, altered, or distorted data causing errors, confusion, misunderstandings, or deception, and shall not falsify or manipulate identifiers to conceal the origin of any content transmitted through the J2W Platform.

 

The User agrees that, when publishing personal data of individuals other than themselves, they shall be responsible for complying with applicable data protection regulations, releasing J2W from any liability arising from the misuse of personal data they may handle within the J2W Platform.

 

The User further agrees not to publish material protected by intellectual property laws.

 

J2W reserves the right to remove any content, comment, or reference that violates the provisions set forth in this document of “Terms and Conditions of Use.”

 1.5 Obligation Regarding the Use of the Site.

The User agrees to strictly follow any instructions provided by J2W or by personnel authorized by J2W related to the Site, concerning any mechanism or procedure established for the proper use of the Site, the J2W Platform, and its Contents.

J2W IS NOT RESPONSIBLE FOR ANY VIOLATION OF APPLICABLE LAWS, RULES, OR REGULATIONS COMMITTED BY YOU OR A THIRD PARTY ON YOUR BEHALF. IT IS YOUR RESPONSIBILITY TO ENSURE THAT YOUR USE OF THE WEBSITE, ITS FUNCTIONALITIES, THE J2W PLATFORM, AND ITS PRODUCTS DOES NOT CONTRAVENE APPLICABLE LAWS, RULES, OR REGULATIONS. Specifically, you agree and warrant that your actions when using the Site, its functionalities, and its products do not violate any applicable laws, rules, and/or regulations.

The User is responsible for any damage and/or harm of any nature caused by failing to comply with these Terms and Conditions of Use or any applicable regulations, expressly releasing J2W from any civil, criminal, administrative, or other liability.

Notwithstanding the foregoing, if J2W is sanctioned or found liable by a competent authority in any proceedings related to civil, criminal, administrative, or other liability, J2W shall notify the responsible User, who must pay J2W the amount required to be covered, as well as the costs, attorney fees, and other expenses incurred, within 15 (fifteen) calendar days following the notification. In the event of payment delay within the specified term, the User agrees to pay J2W, as a penalty, an amount equivalent to the principal amount.

1.6 Contents Submitted by Users or Third Parties.

 

If a User or Third Party chooses to publish or submit any type of content on the Site, only for the sections that are public to any person and non-restrictive, such as the use of the J2W Platform in accordance with section 2 of this document, which may consist of photos, videos, texts, the author agrees to grant J2W a universal, irrevocable, non-exclusive, and sublicensable right over the material, as well as a license for its use, reproduction, adaptation, publication, translation, creation of derivative works from the original, distribution, execution, and presentation of said content (in whole or in part), to incorporate it into another work or project in any form, medium, or technology now known or later developed. If the User does not agree with the provisions of the preceding paragraph, they should refrain from submitting content or material.

 

By submitting articles, files, or any type of information for publication in any section of the Site, only for the sections that are public to any person and non-restrictive, such as the use of the J2W Platform in accordance with section 2 of this document, the author or the person submitting it expressly grants J2W permission to disseminate it in the portal section for which it was sent.

 

J2W is not responsible for the information published by the User in forums or any other space on the portal. Any copyright violation committed by a User will be the exclusive responsibility of the offending User and, under no circumstances, will J2W be held liable. 

1.7 Denial and Withdrawal of Access to the Site and/or Contents.

J2W reserves the right to deny or withdraw access to the Site and/or the Contents at any time and without prior notice, either at its own initiative or at the request of the client or administrator, to any User for any reason, including but not limited to the termination of J2W’s contract validity, or to those Users who misuse the Site, any of its parts or sections, or the Contents, or who fail to comply, fully or partially, with these Terms and Conditions of Use.

 1.8 Links to Third-Party Sites.

J2W may enable access to other Internet sites through “links,” the inclusion of which on this site does not reflect our views or actions, nor does it imply responsibility for the content or management of any such links. The fact that J2W provides access to these sites does not establish or imply any relationship of subordination, control, or economic association between J2W and the owners of these sites. These links are included solely to enhance the user experience, leaving users free to decide whether to access them.

2. J2W Platform.

Below are the features that, depending on the License you acquire, the J2W Platform may include:

 

  1. a) Controlling, managing, and consulting work activities recorded in the J2W Platform.
  2. b) Registering, managing, and administering workday records, schedule management, meeting management, hours worked, and vacations (permissions, requests, anticipated days).
  3. c) Identifying the geographic location when registering the start, breaks, and end of work shifts.
  4. d) Viewing activity reports within the J2W Platform. e) Linking the User’s Microsoft, Google, and Zoom accounts to the J2W Platform when required and contracted.
  5. f) Registering, managing, and administering objectives, tasks, and the activities to meet them.
  6. g) Administering and consulting pay stubs and payment history.
  7. h) Controlling, managing, and notifying requests for certificates related to work activities.
  8. i) Managing internal communications, news, or emails.
  9. j) Executing talent management processes such as planning, recruitment, and selection, onboarding employees, performance evaluations, and talent management.
  10. k) Structuring strategic goals for your company, measuring goal achievement through tools such as Balanced Scorecard, OKRs, and KPI tracking.
  11. l) Generating digital documents, employee history, and their profile in an automated way.
  12. m) Handling and managing digital labor files, gathering information and documentation for integration, such as resumes, photographs, academic certifications, identification documents, proof of address, start dates, among others.
  13. n) Automated generation, registration, management, and administration of contracts and/or any corporate document required to inform employees, ensuring a record that these documents have been communicated, such as policies, codes of conduct, procedure manuals, instructions, commitment letters, etc.
  14. o) Generating payroll calculations for your organization with a parameterized system, complying with local laws and facilitating employee payment processes.

J2W allows its Users to communicate, collaborate, and create in a secure and accessible virtual cloud-based software environment (the “Functionalities”), which is provided through the website https://site.join2work.com/cr and/or its Mobile Application. As such, the entirety of these “Terms and Conditions of Use” also apply.The solution comprises various functionalities that are generally described on the Site.

The content provided by Users within the J2W Platform will only be shared with Users who are previously authorized according to the role and permission settings of the J2W Platform. J2W may offer the use of the J2W Platform through the website and mobile application, both of which are governed by the same “Terms and Conditions of Use” indicated here.

 

The Product license will be subject to the terms of the applicable end-user license agreement contained in the instrument formalizing the service provision.

 

By accessing and using the Site, its Functionalities, downloading, or purchasing the Products, you agree to be bound by and accept these “Terms and Conditions of Use,” as well as all terms and conditions referenced and/or contained in this document and any additional ones established on the website.

 

2.1 Costs and Procurement of the Solution.

 

The costs of the J2W Platform will be governed as indicated on the website https://site.join2work.com/cr.

 

Payments made via credit or debit card are billed and processed through the platform known as “Openpay,” for which you will be redirected to their platform where you can enter your details.

 

2.2 J2W Functionalities.

 

The functionalities available for J2W will be those indicated on the Site, and their operation will be as described on the said Site.

2.3 Access to the Solution

J2W requires you to use your own User Account (the “User Account”) to access the system and its Functionalities. By accessing only your User Account, you agree to provide accurate, up-to-date, and complete information about yourself and to keep this information updated. J2W reserves the right to suspend or cancel any User Account reasonably suspected of containing false, illegal, inaccurate, outdated, or incomplete information. Once you accept these Terms and Conditions of Use and J2W has accepted the registration of your User Account, your account will be established. All activities carried out from the User Account will be attributable to the person to whom the account is linked.

 

You must choose a personal and non-transferable password; therefore, all activities carried out from the User Account will be attributable to the person to whom the account is linked. In this sense, User Accounts cannot be “shared” or used by more than one person. You are solely responsible for all activities that occur in your User Account (including the consequences of using or publishing User Content on or in relation to J2W), whether or not you have authorized such use. You acknowledge and understand that you are responsible for maintaining the confidentiality of your User Account.

 

J2W is not responsible for any damage caused or related to the theft or misuse of your User Account and User Content. However, you may be held responsible for losses caused to J2W due to the misuse and improper use of your User Account.

2.4 Use of the J2W Platform.

The User may use the J2W Platform according to the contracted modules, and it is their responsibility to ensure that such use complies with these Terms and Conditions of Use and, where applicable, the relevant legislation regarding the various activities they will perform within the J2W Platform.

 

The User may upload data, information, materials, and documents to store them in their User Account (the “User Content”), agreeing that it is their responsibility to have the necessary authorizations for its processing, in accordance with the applicable legislation.

 

The User does not have the right to use the Content published or shared on the J2W Platform by other users to appropriate it or use it improperly. The User may only use it to carry out the functions and activities for which the tool is intended, as specified in section 2 of these Terms and Conditions of Use. The User also acknowledges and agrees that J2W is not responsible for any actions taken by individuals to whom they have granted access to their User Content under the license to use the J2W Platform, including modifying, destroying, corrupting, copying, or distributing their User Content.

 

The User accepts and understands that J2W has the right, but not the obligation, at its sole discretion, to filter, monitor, and/or edit any User Content, as well as to reject, delete, or disable access to any User Content that may be illegal or violate these Terms and Conditions of Use at any time and for any reason, with or without prior notice.

 

The User is solely responsible for protecting the information on their computer or other devices, for example, by installing antivirus software, updating applications, password-protecting files, and preventing unauthorized access to their computer. The User acknowledges that other users’ User Content may be damaged by viruses, software malfunctions, or other causes. The User agrees and understands that J2W is not responsible for any damage incurred by any User because of sharing and using such corrupted User Content.

 

The User retains all rights to their User Content, including full authority to legally use, publish, transfer, or license such User Content. The User acknowledges that the User Content is (and will remain) accurate, current, and truthful, does not infringe on any third-party rights, and is not illegal to own, publish, transmit, or display in the country where the User resides or where their end-users reside. 

2.5 Tools for Operating the J2W Platform.

 

If J2W requires the incorporation of external tools or technologies, such integration will adhere to the security considerations established by the owner of such tools or technologies and J2W. The use of these is subject to the independent Terms and Conditions of Use of each tool or technology.

 

J2W is not responsible for any failure, malfunction, or breach of external tools or technologies.

2.6 Service Level, Remote Support.

J2W provides the User with a service level guarantee of 99.97% (ninety-nine point ninety-seven percent) annually. In the event of Platform failures, J2W will provide support and maintenance within a period of 60 to 120 minutes to the Administrator or User, remotely via the Helpcenter, accessible directly from https://join2work.com or through the email address soporte.plataformas@pilartechs.com. Support hours are Monday to Friday from 9:00 a.m. to 6:00 p.m., except on non-working days as defined by local legislation and/or those specifically notified to the User by J2W.

 
3. Contact Section. 

The Site publishes mechanisms through which Users can contact J2W. These mechanisms are operated and managed by J2W, as indicated in the previous section.

If the User chooses to use the contact mechanism through forms provided for this purpose, the information entered in such forms is governed by the Privacy Notice published on the Site. Additionally, the data provided by the User must correspond to their own information, or, in the case of entering data about another person, they must have authorization for the registration. This constitutes a transfer of personal data, in which the User assumes the role of Responsible Transferor.

4. Intellectual Property of the Site and the J2W Platform.
 

Regarding Copyrights, unless the content is attributed to a specific author or is in the public domain, all content hosted or made available on the Site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations is the property of J2W and is protected by applicable intellectual property rights.

 

Regarding Trademarks, the registered trademarks and trade dress of J2W may not be used in any manner likely to cause confusion among users or to disparage or discredit the owner.

 

The User agrees not to publish, distribute, copy, reproduce, duplicate, transmit, disseminate, sell, transfer, or exploit in any way, for any purpose, all or any part of the Functionalities, information, or content of J2W under any circumstances.

 

The User does not need to request permission to use a link directing to the Site, provided the link leads to https://site.join2work.com/ in a separate window where the URL is clearly visible.

 

If any User or a third party believes that any Content on or introduced into the Site violates their intellectual property rights, they should notify J2W by sending an email to dataprivacy@join2work.com. Upon receiving such notification, J2W will contact the claimant to address the matter.

5. Personal Data Protection.

In matters of personal data protection, the provisions outlined in J2W’s Privacy Notice published on the Site https://site.join2work.com/cr and the J2W Platform https://join2work.com/login, under the Privacy Notice section, shall apply.

 

It is important to note that J2W is responsible for the personal data related to the Administrators and Users of the J2W Platform. However, regarding the personal data entered the J2W Platform by its Users, those Users are responsible for ensuring that the processing they perform complies with the applicable regulations in force on personal data protection.

 6. Final Provisions.

6.1 Duration and Termination.

 

The Site and its Contents are of indefinite duration. However, J2W may terminate, suspend, or interrupt the Site and/or any of its Contents at any time and without prior notice.

The User acknowledges that J2W, at its sole discretion and without prior notification, may terminate or suspend the use of certain Functionalities for any reason or cause, recognizing that J2W will not be liable to the User or third parties for such termination or suspension.

If the Site is unavailable, J2W will indicate such unavailability and, if possible, provide the reason for the Site’s unavailability.

 

6.2 Exclusion of Warranties and Liability.

 

Exclusion of Warranties and Liability for the Functionality of the Site and Contents, Viruses, and Other Harmful Elements J2W does not control or guarantee the absence of viruses in the Contents, nor the absence of other elements within the Contents that could cause alterations to the User’s computer system (software and/or hardware) or to the electronic documents and files stored on their computer system.

 

J2W makes every effort to ensure that its website functions correctly and without errors and that the information published is accurate and useful for its Users. However, J2W does not assume any responsibility for the information provided on the site, including but not limited to products and/or Functionalities, points of interest, advice, tips, and frequently asked questions. Similarly, it does not assume any responsibility for the inability or issues in the use of the website or any of its pages.

6.3 Form.

The User agrees that a printed version of these Terms and Conditions of Use, as well as any communication sent and/or received electronically (as applicable), will be admissible as evidence in any judicial and/or administrative proceeding.

6.4 Modifications.

J2W reserves the right to unilaterally and without prior notice modify the Content and Functionalities provided through this Site. To ensure clarity, J2W will include the date of the latest update of this document. Consequently, all operations, Functionalities, and transactions conducted after the modification of these Terms and Conditions of Use will be governed by the updated text. It is the User’s responsibility to regularly review the Terms and Conditions of Use published on this Site and its Mobile Application. The terms of this document cannot be altered, supplemented, or amended through any other document. 

6.5 Assignment.

J2W may, without the User’s authorization, assign the rights and obligations contained in these Terms and Conditions of Use to any third party.

 

6.6 Unenforceable Provisions.

If any of the Terms and Conditions of Use expressed herein are deemed unenforceable or declared null or void under applicable law, they shall be replaced by a valid term or condition that most closely aligns with the intent of the unenforceable, null, or void provision. Provisions that are not affected shall remain in full force and effect.

6.7 Applicable Law and Jurisdiction.

In all matters related to the interpretation and fulfillment of what is stipulated herein, by merely accessing the Site, Users agree to submit to the applicable laws in the territorial jurisdiction where the service provider is located, as indicated in the first paragraph of this document. Users waive any other jurisdiction that may correspond to them due to their current or future domicile or for any other reason.

6.8 Rights.

Any rights not expressly granted in this document are understood to be reserved by J2W.
